Mediation at Work

Mediation is a tool to resolve workplace conflict or disputes. It's often described as a form of alternative or informal dispute resolution as it's less formal than grievance and discipline procedures and employment tribunals whilst still following a structured approach.

Mediation is a voluntary and confidential process

The success of mediation lies partly in the fact that it is voluntary, and the parties enter the process as willing participants with a common goal of wanting to sort out their differences.

If an individual doesn’t want to take part in mediation, they do not have to. Also, if at any point during the proceedings, one of the parties wants to withdraw from the mediation for any reason, the process will cease with no blame attributed to any party.

A mediation may end in an agreement between the parties, or there may be no agreement, even where there has been no breakdown in the process.

Mediation is voluntary and confidential. The mediator will agree with everyone involved on what information can be shared outside the mediation and how. If an agreement is not reached, anything that's been said during the mediation must be kept confidential and cannot be used in future procedures.

Managers and/or HR will only be informed if the process has been successful or not – no other details will be shared unless with consent from both parties.
